As stated in Section 8 of the Occupation Health and Safety Act 83 of 1995 in South Africa;
"Every employer shall provide and maintain, as far as is reasonably practicable, a working environment that is safe and without risk to the health of his employees."
and additionally in the Construction Regulations 2014, in section 10.2.c
"a programme for the training of employees working from a fall risk position and the records thereof".
Please note, there are multiple sections in the construction regulations that speaks to and defines what is expected in terms of work done at heights.

The OSH Act and regulations call for the proper management of hazards and risks in the workplace and working at heights carries a simple but deadly risk. The risk of an individual falling from a height, and causing seriously bodily harm or death.
The employer has a legal obligation to remove that risk, and they do so, in this scenario, by supplying the employee with the correct equipment to use, and training them up on the hazards and risks associated with their work, how to use their equipment correctly and what to do in an emergency.
What will happen if you don't follow the correct procedure?
Non-conformances to health and safety carry serious penalties to the employer and the management team, as seen in section 38 of the OSH Act, "Offences, Penalties and special orders of court", where employers could receive a minimum of 2 years jail sentence, a massive fine, or both.
Who is considered the employer in question?
According to Section 332 of the CRIMINAL PROCEDURE ACT 51 of 1977, the following persons may be prosecuted individually and jointly with the Company:
CEO (Appointed 16(1));
Directors; Assistant CEO (Appointed 16(2));
Other Chief Officers Appointed (CFO, COO);
Managers; Supervisors etc.
and Responsible Employee or Operator.
In other words, if you, no matter who you are, personally instructed a staff member to work at heights without following proper procedures or removing the risks associated with fall arrest and working at heights, you and your employer a legally liable for what ever happens.

Fall arrest is a process where systems, equipment and training is implemented and utilized with the sole purpose of protecting individuals and employees, working at heights, from falling and getting seriously injured or worst case scenario, death.
