In the Occupational Health and Safety Act of South Africa, it stipulates quite clearly that the business owners, director or shareholder is legally responsible for the safety of their employees.
It can be seen in Section 8 of the OSH Act;
"Every employer shall provide and maintain, as far as is reasonably practicable, a working environment that is safe and without risk to the health of his employees."
Further in Section 16 in the OSH Act;
"16. (1) Every chief executive officer shall as far as is reasonably practicable ensure that the duties of his employer as contemplated in this Act, are properly discharged."
So as you can see, the act places the ownership of safety right at the top of the organization, the big boss.
However, the law does understand that most business owners, or the executives are busy, and do not have the time to maintain a safety system in their workplace, so the law permits the employer to delegate someone or a team to do the work on their behalf.
As see in section 16.2 of the OSH Act;
"(2) Without derogating from his responsibility or liability in terms of subsection (1), a chief executive, officer may assign any duty contemplated in the said subsection, to any person under his control, which person shall act subject to the .• control and directions of the chief executive officer."
This person or persons will act on the owners behalf, ensuring that health and safety in their workplace is implemented properly, maintained and managed on a day to day basis.
This appointment, however, does not take away the legal liability from the employer, that is why it is so important to have this individual trained up, to give them the most knowledge on the topic of safety in the workplace, to teach them how to implement it and manage it.
This person carries a lot for the employer, they ensure that the content of the Occupational Health and Safety act are adhered too and that the employer does not fall short, and succumb to legal liability due to non-compliance.

A person or employee that has been delegated and trained for the task of managing occupational health and safety in their workplace. They are responsible for the implementation, maintenance and management of a safety system and the people involved in it.
